Qualpay is committed to providing privacy and security to our merchants, partners, and vendors. This Policy describes how we collect, use, and protect your information. Please read this Policy carefully to get a clear understanding of how your information is handled and how to contact us for further information.

Applicability of Privacy Policy

This Privacy Policy applies to Qualpay’s website and platform, and all other interactions you may have with Qualpay (“Services”). If you do not agree with the terms of this Policy, please do not access or use our website, platform, or any other part of Qualpay’s business. We do not use your information for any purposes other than what is stated in this Policy.

Occasionally, at our discretion, we may include or offer Third-Party products or services on our website. These Third-Party sites have separate and independent privacy policies. This Policy does not apply to any Third-Party applications or software that integrates with Qualpay’s Services. Please refer to the Third-Party’s privacy policy for more information. We welcome any feedback about these sites.

Information We Collect

This Privacy Policy has been compiled to better serve our customers who are concerned with how their 'Personally Identifiable Information' (“PII”) or ‘Personal Information’ (“PI”) is being used online. PII and PI, as used in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in the context of usage. Information is collected when you visit our website, fill out an online form, apply for a merchant account, or otherwise provide your information for the purpose of doing business with us.

How We Collect Information

• Visiting our website: When registering on our site, as appropriate, you may be asked to enter your name, email address, business name, mailing address, and phone number. The information will be used to provide further details on our services and pricing.
• Applying for a Merchant Account: When you apply for a merchant account with us, more detailed information will be requested, including but not limited to social security number, tax identification number, and banking information. As part of the application process, we may also obtain information about you from Third-Parties such as credit bureaus and identity verification services. This information is used solely to evaluate your account request.
• Other Information: To create relationships with partners and vendors, we may collect your information if you represent one of these business partners.

Types of Information We Collect

Categories of Personal Information collected include the following types:

• Identifiers, Customer Records Information, and Sensitive Personal Information: We collect information such as name, telephone, address, IP address, social security numbers, driver’s license numbers, bank account numbers, employment history, and other similar identifiers to enable us to evaluate account requests, provide services, and conduct due diligence reviews on merchants, vendors, and other partners.
• Characteristics of Protected Classifications: We collect some information which is protected by state and federal law, including the identifiers listed in the section above, as well as birth dates and gender information to enable us to evaluate account requests, provide services, and conduct due diligence reviews on merchants, vendors, and other partners.
• Professional, Employment, and Education Information: In connection with our business partnerships, and in order to evaluate a merchant account application, we will occasionally collect employment and educational information such as a resume from you.
• Internet or other Network Activity Information: The following information may be collected from you while using Qualpay’s Services:
• Cookies: Cookies are small files that a site or their service provider transfers to your computer's hard drive through your Web browser (if you allow), that enables the site's or service provider's systems to recognize your browser and capture as well as remember certain information. We also use cookies to compile aggregate data about site traffic and site interactions in order to offer better site experiences and tools in the future. We may also use trusted Third-Party services that track this information on our behalf. We also send a "session cookie" to your computer when you sign up for and log in to your account. This type of cookie helps us to recognize you if you visit multiple pages on our site during the same session so that we don't need to ask you for your password on each page. Once you log out or close your browser, this cookie expires and no longer has any effect.

Qualpay uses your information for the legitimate purpose of providing our Services. In addition to the uses outlined above, we use the information we collect for the following purposes:

• As required by applicable law or regulation.

• To respond to your requests, comments and questions.
• To develop, enhance, and expand our Services to you.
• For billing, account management and other administrative matters.
• To prevent, investigate, and respond to security issues.

Information We Share

Qualpay does not sell your information. Information used in evaluating an application for a merchant account and other business relationships may be shared with Third-Parties who enable us to evaluate account requests, conduct due diligence reviews, and support the requested services. Identifiers, Characteristics of Protected Classifications, Professional and Educational information may be shared with Third-Parties to provide you with a merchant account or other related services. Qualpay may also share your information to comply with laws, regulations, or legal process.

Security and Protection

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

Your Personal Information is encrypted and stored behind our secured network and in addition, is available only to a limited number of persons who have special access rights to such systems, and are required to keep this information confidential. In addition, all sensitive information that you supply is encrypted via Secure Socket Layer (SSL) technology.

We implement a variety of security measures to protect your information and follow best practices for security in order to maintain our Payment Card Industry (PCI) Data Security Standards certification as a Level 1 Processor.

Changes to Privacy Policy

Users will be notified of any privacy policy changes on our Privacy Policy and are able to change their personal information by contacting us. The Policy will be posted on the Qualpay website, and the revised version will be effective at the time posted.

Age Limitations

To the extent possible, we do not allow the use of our Website or Services by anyone under the age of 16. If you learn of anyone under 16 who has accessed our Services or provided Personal Information, please contact us so we may delete this information.

Fair Information Practices

Qualpay cares about keeping your data safe, and in addition to applicable laws and regulations, we comply with the Fair Information Practices. In the event of a data breach, we will take the following responsive actions:

• We will notify the users via email within seven (7) business days
• We will notify the users via in-site notification within seven (7) business days
